Misconduct
I. The Legislation
Subsection 30(1) of the Employment Insurance Act provide that claimants who lose their employment by reason of their own misconduct are disqualified from receiving benefits.

Where a claimant is disqualified to benefits by reason of misconduct, the legislation requires that he or she be given the benefit of the doubt provided that the Commission's and the claimant's evidence is equal.
