3.4 Types of Evidence

3.4.2 Testimony

Testimony is a statement by which a person relates facts of which he has personal knowledge, or by which an expert gives an opinion. Ordinary witnesses may also be allowed to state an opinion, or even testify about facts or situations of which they have no personal knowledge (i.e., hearsay). Lawyers cannot be considered expert witnesses because this would encroach on the function of the judge, who is supposed to know the law. It is up to each party to call and present its own witnesses.474 Citation 474 The parties as well as their representatives may testify.475 Citation 475
